1. Business Identity & Service Area

Nova Noir Studio and Photobooths (“Company”) is located at 125 E 37th St., Chicago, Illinois.

Service Area: Primarily serving the Chicagoland area.

Delivery Fee: A flat fee of $40.00 is applied to all deliveries within the service area.

2. Payments & Cancellations

Non-Refundable Retainer: A retainer is required to secure the event date and is non-refundable under all circumstances.

Cancellation Policy: Clients may cancel up to seven (7) days prior to the event for a partial refund (total amount minus the retainer). Within 7 days, all payments are forfeited.

Indoor Requirement: Company does not operate outdoors. Failure to provide a climate-controlled indoor space for setup will result in immediate cancellation of services without a refund.

3. Equipment & Host Liability

Host Responsibility: The Event Host (Client) assumes full financial responsibility for any damage to props, hardware, or booth equipment caused by guests.

Technical Performance: Company relies on external internet and power. While we strive for seamless service, the Company is not liable for “hiccups,” slow upload speeds, or delays caused by venue conditions.

4. Image Rights & Biometric Consent (Illinois BIPA)

Model Release: By using the booth, guests grant the Company permission to use images for marketing and social media.

Biometric Processing: This booth uses AI for digital filters. By participating, guests consent to the temporary processing of facial geometry. No biometric data is stored by the Company after the session ends.

5. ADA Disclaimer

Current equipment configurations are not wheelchair accessible. While our team will make reasonable efforts to accommodate all guests, we cannot guarantee standard operation for guests in wheelchairs or those with limited mobility.

6. Independent Services & Limitation of Liability

The website developed by G&U Studios serves as a booking and informational platform only. All post-event digital delivery—including but not limited to QR code generation, SMS/text delivery, and digital gallery hosting—is managed via independent third-party applications selected by the Company. G&U Studios does not manage, store, or transmit guest contact data or biometric data and shall be held harmless for any technical failures, data breaches, or delivery errors originating from these third-party systems.
